When the matter was taken up, the learned Standing Counsel for the Railways submitted that the order fixing the date of hearing of the applicant pursuant to the direction of this Tribunal dated 05.07.2024 will be issued by the 2nd respondent will be issued shortly. We take note of the fact that though the order was passed in 2024 and the matter was posted as last chance on 06.08.2026 and on 16.09.2026, the order has not been complied with even now. We are now informed that the 2nd respondent is issuing notice for hearing today. We are also informed that there was some confussion as to whether the 2nd respondent has to hear the representation itself. We find from the order that the specific direction was given to the 2nd respondent to hear the matter. In the light of clear direction, there was no reason for the 2nd respondent to sleep over the matte till last opportunity was given. We do not appreciate the conduct of the 2nd respondent. However in the light of assurance made, we are inclined to direct that notice shall be issued by the 2nd respondent today itself fixing the date after two weeks and final order shall be passed within three weeks thereafter. The order shall be made available before the Tribunal on or before 25.11.2026, failing which, 2nd respondent shall appear personally on 27.11.2026. Post on 27.11.2026.
