O R D E R
(Order of the Court was made by G.Jayachandran J.) This Writ Petition has been filed challenging the proceedings in Na.Ka.No.2236/2026/A1, dated 13.08.2026, issued by the second respondent in exercise of powers under Section 6 of the Tamil Nadu Land Encroachment Act, 1905.
2. The Learned Special Government Pleader appearing for the respondents submits that the order of the Tahsildar issued under Section 6 of the Tamil Nadu Land Encroachment Act is an appealable order and in fact the petitioner has already preferred an appeal before the District Collector and the same is pending. The date of hearing for the parties been fixed on 15.10.2026.
3. Taking note of the fact that the challenge to an order under Section 6 of Tamil Nadu Land Encroachment Act, by way of Writ Petition is not sustainable and the petitioner has already approached the appellate authority by way of appeal, this Writ Petition is disposed of with liberty to the petitioner to raise all grounds during the enquiry in the appeal. ____________ Page Nos.2/5
