ORDER

(Order of the Court was made by G.Jayachandran J.) The petitioner herein, claiming himself as refugee from Sri Lanka, along with other refugees, had purchased properties in and around Erode. It is alleged that the State Government had promised to provide a sum of Rs.10,000/- to each beneficiary for construction of houses and taken all the original title documents from about 2,500 refugees. However, after creating mortgages, except in respect of nine beneficiaries, the loans were not sanctioned and the money was

W.P.No.38339 of 2026 presumably appropriated by the officials. Hence, the Deputy Superintendent of Police, Vigilance and Anti-Corruption, Erode had taken cognizance of the offence and collected all the documents, inspite of the direction issued by this Court in an earlier petition filed by the petitioner to consider the representation seeking return of the documents. Since the respondents have not returned the documents, the present petition has been filed seeking mandamus to consider the representation dated 13.07.2026.

2. According to the learned counsel appearing for the petitioner, the lands are now encroached by third parties and, therefore, the encroachments must also be removed, in addition to the return of the title documents.

3. On perusal of the representation and the submissions made by the learned counsels, this Court finds that there is serious doubt regarding the credentials of the petitioner herein.

4. The petitioner claims in the affidavit that he is a Sri Lankan refugee. However, he has also enclosed an Aadhaar Card issued by the Government of India bearing No.5900 4315 9480. He claims to be the owner of the property, but when this Court enquired the document to establish his ownership, the learned counsel submitted that all the documents are presently with the police,

W.P.No.38339 of 2026 which are investigating the case. There is not even a piece of material found in the affidavit to examine whether the petitioner owns any property in the said survey numbers. Further, when we enquired with the learned counsel as to what authority under which the representation has been made seeking return of the original documents of third parties, the learned counsel, without any compulsion say that they would collect the documents and hand them over to the concerned persons. This is not a public interest litigation filed on behalf of parties who are not capable of agitating their cause.

5. Therefore, the Superintendent of Police, District Crime Branch(DCB), Erode District, is directed to probe into the antecedents of the petitioner and the genuineness of the Aadhaar Card furnished along with this Writ Petition and to take appropriate action if any impersonation, fraud or cheating is found.

6. Accordingly the Writ Petition is dismissed. There shall be no order as to costs.

7. The Superintendent of Police, District Crime Branch (DCB), Erode District, is directed to file report on his investigation within four weeks pertaining to the genuineness of the Aadhaar card furnished before this Court while filing this writ petition. Though we dismiss the Writ Petition, in order to
