(Order of the Court was made by G.Jayachandran, J.) The petitioner herein, being an illegal occupant of the notified forest land, was sought to be evicted and also alternate site for his residence been provided under the scheme at the cost of the Forest Department. Alleging that the eviction notice must be given under the Tamil Nadu Protection of Tanks and Eviction of Encroachment Act and not under the Forest Act, the present petition has been filed.

2. We do not find even an iota of reason to interfere with the impugned order. The petitioner, who is the gross encroacher of Government forest land, has fortunately been provided with an alternate site for his residence. While so, despite been given an alternate site, the attempt to squatting over the forest land through this present petition is highly deplorable.

3. Hence, this Writ Petition is dismissed. If the petitioner fails to vacate the forest land on his own, the alternate site allotted to him shall stand cancelled forthwith, without any further hearing. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed. (Dr. G.JAYACHANDRAN, J.) & (E.MANOHARAN, J.) 30-09-2026 Page Nos.2/4
