CENTRAL ADMINISTRATIVE TRIBUNAL ERNAKULAM Order Sheet Item no.: 17 O.A./467/2026 (ERNAKULAM) [ PROMOTION ] [ SENIOR CITIZEN ] Court No.: 2 No of Adjournment: 3 Order Dated: 13/10/2026 CHRISTOPHER M Vs DEPARTMENT OF SPACE For Applicant(s) Advocate : Mr. Kaleeswaram Raj For Respondent(s) Advocate : Mr. M.N. Manmadan, SCGSC Notes of The Registry Order of The Tribunal Today when taken up, the learned SCGSC seeks time for filing detailed reply statement. Meanwhile, the learned Counsel for the applicant has submitted that the applicant is retiring on 30.11.2026, so that the respondents have to be directed for conducting a review DPC for granting him promotion as Scientist/ Engineer "G". We have heard the learned Counsel on both sides. It is submitted that the applicant has over 35 years of unblemished service to his credit. The APAR ratings are outstanding. Despite all, he has not been promoted to the post of Scientist/ Engineer "G". Everytime, after conducting review DPC, the Committee has recommended for relook after six months. According to the learned Counsel, there is no justification in denying promotion which is due to him. According to the learned Senior Central Government Standing Counsel, as seen in Annexure A6, his case was lastly reviewed on 13.07.2026 and the Committee has recommended for a 'relook'. Further it is submitted that the reasons for not granting promotion need not be recorded. He also submitted that the Annexure A7 representation submitted by the applicant has already been considered and rejected and the copy of the order communicated to the applicant. After hearing the learned Counsel on both sides, we are not inclined to grant an interim order as prayed for. Similar claims were considered by us in O.A Nos. 107/2026 and 132/2026. By common order dated 03.06.2026, basing on the judgment of the Hon'ble Supreme Court in Dalpat Abasahed Solunke and Ors v. Dr. B.S. Mahajan and Ors. [1990 KHC 714] dated 06.12.1989, both the OAs were dismissed. It appears that the order has become final. A copy of the order has been placed before us. In the circumstances, the request for granting an interim order is rejected. 2026.10.13 14:08:01 +05'30' VISHAL
