Heard both sides.

2. Mr. D. Rajaboopathy, learned Government Advocate (Criminal Side) takes notice for the respondent.

3. The petitioner challenges the rejection order passed by the respondent under the impugned order dated 26.09.2026, whereby the petitioner's request for granting permission and police protection to conduct “Adal Padal” programme on the occasion of the Mulaipari festival of Arulmigu Muthu Mariamman Temple, situated at Kumarakurichi village, Illayangudi Taluk, Sivagangai District on 30.09.2026 i.e. today.

4. The learned counsel for the petitioner, who is practicing in this Court, watching the day to day proceedings of this Court and, being aware of the same, might have advised the petitioner that, instead of conducting “Adal Padal” programme, the petitioner may conduct an “Innisai Pattu Katcheri”. In this regard, the petitioner has come forward with an additional affidavit dated 30.09.2026, stating that, though the rejection order was passed by the respondent in respect of the “Adal Padal” programme, which is under challenge, the petitioner now intends to conduct an “Innisai Paatu Katcheri” and not an “Aadal Paadal” programme. Therefore, the petitioner seeks permission to conduct only an “Innisai Pattu Katcheri”, without any dance, drama, etc., with the police protection. The affidavit of the petitioner is recorded.

5. The learned Government Advocate (Criminal Side) submitted that, since the petitioner has come forward stating that he would not conduct “Adal Padal” programme, but only the “Innisai Paatu Katcheri”, which is a light music programme involving only singing of songs and no dance, the petitioner may be permitted to conduct the same, subject to the condition that if there is any mimicry the same may be conducted without touching sentiments of any other community in the locality. Therefore, the learned Government Advocate (Criminal Side) submitted that the petitioner may be permitted to conduct the programme, subject to the usual conditions imposed for conducting such programmes.

6. Recording the affidavit of the petitioner, the writ petition is disposed of by setting aside the impugned order, with the following directions:

(i) The petitioner is permitted to conduct only an “Innisai Pattu Katcheri” by singing the songs and shall not conduct any “Adal Padal” dance, drama, etc.

(ii) The petitioner is also permitted to conduct mimicry, provided that the same does not hurt the sentiments of any other community or contain any objectionable words.

(iii) The police authorities are directed to issue necessary permission and provide protection, free of cost, for conducting the said programme.

(iv) If the petitioner violates any of the aforesaid conditions, the police authorities are directed to stop the programme forthwith and initiate appropriate legal action against the petitioner in accordance with law.

7. Mr. Muthaiya, Sub-Inspector of Police from Ilayangudi Police Station, is present before this Court, during the course of the hearing and he has understood the order of this Court. Therefore, he is directed to inform the Inspector of Police to issue necessary permission and police protection today itself.

8. With the above directions, this writ petition is disposed of. 30-09-2026 Index :Yes/No Internet :Yes/No NCC :Yes/No psm To
