Heard both sides.

2. Mr. A. Sivasubramaninan, learned Additional Government Pleader, takes notice for the 1st respondent and Mr. D. Rajaboopathy, learned Government Advocate (Criminal Side), takes notice for the respondents 2 to 4.

3. The prayer in the Writ Petition is to challenge the rejection order passed by the fourth respondent, in which, the request of the petitioner seeking permission and police protection to the Rekla Race on 04.10.2026 from Vellaluar to Aatukulam villaku in connection with the Vellaluar Nadu Elaikataaman Temple Function, was declined for the various reasons mentioned in the rejection order dated 23.09.2026.

4. The learned counsel for the petitioner submitted that, in the previous years also, a similar issue arose and one Mr. Ramalingam approached this Court by filing WP.Crl.(MD) No.1287 of 2026 and the same was allowed by directing the petitioner therein to submit a fresh representation. Here the petitioner is not the same person of Mr. Ramalingam, but Mr. Arasakumar. When the Rekla Race is to be conducted several bullock carts would be involved and the human participation also be involved in the race.

5. In such circumstances, there is a possibility of an untoward incident, for which, a single person cannot be a responsible and there must be a committee of members in the village to conduct the festival. However, no such committee or member have been mentioned in the representation submitted by the petitioner or in the affidavit filed by the petitioner. The primary purpose of the petitioner appears to be to obtain permission for conducting Rekla Race. If the submission of the petitioner is taken into consideration, if any untoward incident taken place under the Rekla Race procession, the entire village people will be in trouble for one man act for seeking permission.

6. Therefore, the rejection order of the 4th respondent cannot be assailed which is found in lieu with the facts and circumstances, of the present case.

7. Recording the above reasons, this petition is dismissed. However, the petitioner is at liberty to form a committee consisting of members and submit a joint representation duly signed by all the members. Then, the police may consider the same and pass approriate orders in accordance with law. If necessary, the police authorities may impose any other conditions required and may seek for NOCs from Veterinary Department, Revenue Authorities, State Highways Authorities, Medical Department etc., On production of all those certificates or NOCs for permission and protection and if a representation duly signed by the members of the committee, along with the certificates, shall the police authorities consider the representation and pass appropriate orders thereon. 30-09-2026
