PRAYER:
(Water Body) Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus to directing the respondent to conduct a proper survey / inspection of the Mudikandam Periyakulam comprised in Survey No.82 of Mudikandam Revenue Village, Srirangam Taluk, Tiruchirappalli District identify all encroachments and unauthorised occupations herein, remove the encroachments in accordance with law restore the water body to its original status and take effective steps to prevent further encroachment and pass such further or other orders as this court may deem fit and proper in the circumstances of this case and thus render justice.

ORDER
Heard the learned counsel appearing for the writ petitioner and the learned Additional Government Pleader appearing for respondents 1 to 4. Issuance of notice to the private respondent is dispensed with.
2. The writ petitioner is a resident of Edamalaipatti Pudur, Tiruchirappalli He alleges that in the petition mentioned water body, there are encroachments and that they have to be cleared.

The learned counsel appearing for the official respondents on instructions, submitted that the petitioner's representation would be considered and that the authorities concerned would conduct a survey of the land in question in the presence of all the parties concerned. He further submitted that appropriate action would be taken to remove the encroachment, if any.
4. In such view of the matter, the authorities concerned are directed to conduct a survey in the place in question, after issuing notice to the petitioner and other interested parties, if any, within a period of two weeks from the date of receipt of a copy of this order. If the survey reveals any encroachment, the authorities concerned shall take necessary action for removal of such encroachment, after affording sufficient opportunity of personal hearing to all the parties concerned and by following due process of law, within a period of three months thereafter.
