WP(MD) No. 28345 of 2026 Private Schools (Regulation) Rules, 1974, on the basis of his representation dated 08.08.2026.

2. The learned counsel appearing for the petitioner submits that the fourth respondent, who is working as a Teacher in CMS School, Tirunelveli has received huge amount from this petitioner, on a false promise that she and her husband would purchase properties for the petitioner and thereafter, cheated him. As the fourth respondent is governed by Tamil Nadu Recognized Private Schools (Regulation) Rules, 1974, the petitioner has approached this Court to direct the District Educational Officer, the Chief Educational Officer, Tirunelveli and the Correspondent of CMS School, Tirunelveli to take action as against the fourth respondent for the violation of code of conduct under Rule 16(1), Annexure II of the Tamil Nadu Recognized Private Schools (Regulation) Rules, 1974. It is also reported that a suit in OS No.45 of 2025, on the file of the Additional District Court, Tirunelveli is __________

3. Mr.C.Jeganathan, learned Special Government Pleader takes notice for the respondents 1 to 3 and submits that this writ petition cannot be maintained.

4. Taking a decision to initiate disciplinary action against the teacher of a Private School lies entirely with the employer and it is not for the writ petitioner to ask for issuance of Writ of Mandamus. The petitioner is not having any legal right to seek for appropriate action as against the fourth respondent herein and at the most, he can redress his grievance before the concerned authority. As such, this Court do not find any merits in the prayer sought for in the present Writ Petition. __________
