COMMON ORDER
These Criminal Revision Cases challenge the dismissal of the petitions seeking interim custody of the sums of Rs.66,60,000/- and Rs.35,00,000/- respectively, seized during the course of investigation in Crime Nos.23 of 2024 and 58 of 2023.
2. Learned counsel for the petitioners would submit that since the parties have entered into a compromise, Memorandum of Understanding were entered between them and hence, the impugned orders are liable to be set aside and that the petitioners are entitled to the interim custody of the amount seized in Crime Nos.23 of 2024 and 58 of 2023.
3. Learned counsel for the second respondent would submit that the Memorandum of Understanding (MOU) entered into between the parties have not been acted upon, as the petitioners have not complied with its terms and therefore, there is no infirmity in the impugned orders dated 15.06.2024 directing the seized money to be kept in a fixed deposit.
4. Since, it is now reported that the MOU entered into between the parties have not been acted upon, this Court finds no infirmity whatsoever in the impugned orders directing the seized money to be kept in a fixed deposit, pending the filing of the final report by the first respondent police.
5. Accordingly, these Criminal Revision Cases are dismissed. However, the petitioners are at liberty to renew their application after the investigation is completed in Crime Nos.23 of 2024 and 58 of 2023, which shall be considered on merits and in accordance with law. 29-09-2026 Neutral Citation: Yes/No 3ham To
