ORDER

Today, the learned counsel for the petitioner has filed an affidavit of undertaking of the petitioner, Mr.M.Chandrasekaran, undertaking to vacate and hand over vacant possession of the tenanted premises by 31.03.2027. The

CRP No. 4208 of 2024

learned counsel for the petitioner also stated that the petitioner is willing to pay the admitted arrears of rent which come to about Rs.7,50,000/- as on date.

2. Though in the affidavit the petitioner has stated that he may be permitted to remove the superstructure constructed by him as well as the bore well, pipe connection and covered roof with GIC sheets and other electrical items and fittings inside the premises installed by the petitioner, strong exception is taken by Mr.B.K.Srineevasan, learned counsel for the respondents, on the ground that both the Courts have rejected the contention of the petitioner that the petitioner had put up construction.

3. The learned counsel for the respondents also brings to my notice that the property tax is assessed only in the name of the respondents. He also stated that the suit is already pending in O.S.No.6137 of 2023 for recovery of arrears of rent and liberty may be given to the respondents to proceed with the suit and recover the entire arrears of rent, without accepting the concessional amount that is now being offered by the petitioner.

4. In the light of the above and recording the affidavit of undertaking dated 28.09.2026, the petitioner is granted time to vacate the tenanted premises by 31.03.2027, with permission to remove only the GIC sheet construction put up by the petitioner at his cost and take his personal belongings. The petitioner

shall not be entitled to remove the hollow block compound wall and any permanent construction that is available inside the tenanted premises.

5. The Civil Revision Petition is dismissed, granting time to the petitioner to vacate the tenanted premises till 31.03.2027. The parties shall workout their respective contentions in the pending suit in O.S.No.6137 of 2023 on the file of the XVI Additional City Civil Court, Chennai, insofar as the arrears of rent. No costs. Connected Civil Miscellaneous Petition is closed. 29-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No ATA To The XXI Additional City Civil Court, Allikulam, Chennai.
