ORDER
This revision petition has been filed to direct the learned Subordinate Judge, Poonamallee, to dispose of E.P.No.105 of 2010 in O.S.No.213 of 1993.
2. Heard the learned counsel for the petitioner-decree holder.
3. Considering the limited relief sought for in this revision petition, I am inclined to dispense with notice to the respondent-judgment debtor.
CRP No. 5916 of 2026
4. The learned counsel for the petitioner fairly brought to my notice, which has also been stated in the memorandum of grounds in the revision, that on one occasion, the EP was dismissed for non-prosecution, but however, subsequently, it has been restored. He would also bring to my notice that despite two directions issued by this Court one in CRP.No.3910 of 2022 and another in Tr.CMP.No.411 of 2024, directing expeditious disposal of the execution petition, the judgment debtor is delaying the proceedings, by filing some applications one after the other. Today, according to the learned counsel for the petitioner, all the miscellaneous applications have already been dismissed/rejected and only orders have to be passed in the main execution petition.
5. Considering that the EP is pending for over 16 years, I am inclined to direct the learned Subordinate Judge, Poonamallee, to dispose of E.P.No.105 of 2010, by 30.11.2026, without seeking any further extension of time.
6. The Civil Revision Petition is allowed with the above direction. No costs. 29-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No ATA
