JUDGMENT
(Judgment of the Court was delivered by P.Velmurugan J.) Today, when the matter is called for hearing, the learned counsel appearing for the appellant submitted that this appeal has been filed against the

order passed in the application seeking to issue a subpoena and now trial commenced in the main suit and hence nothing survives in this appeal and the same may be dismissed as infructuous.
