JUDGMENT
(Judgment of the Court was delivered by P.Velmurugan J.) The appellant is defendant and the respondent is plaintiff in C.S.No.94 of 2022. The respondent/plaintiff filed the said suit for recovery of money.
Pending suit, the respondent/plaintiff filed an Application in A.No.2146 of 2022 to direct the appellant/defendant to furnish security to the suit claim for a sum of Rs.11,96,32,258/-.
The learned Single Judge, after hearing both the learned Senior Counsel appearing for the appellant/defendant as well as the respondent/plaintiff at length, vide order dated 14.11.2022 directed the appellant/defendant to furnish security to the suit claim for a sum of Rs.11,96,32,258/- on or before 12.12.2022.
Aggrieved over the said direction, the defendant is before us with the present Original Side Appeal.
Toady, when this Court posted the question as to the stage of the suit, it is stated that trial commenced, plaintiff side evidence completed and the defendant has to get in the box. Further the appellant/defendant has filed two applications to receive additional documents, which are yet to be decided.
The order impugned in the present Original Side Appeal was passed only in the Application in the year 2022 itself. Now trial commenced in the Civil Suit and plaintiff side evidence also completed. At this juncture, we are not inclined to interfere with the order passed in the Application.
Accordingly, the Original Side Appeal stands dismissed. Consequently connected miscellaneous petition is closed. No costs. However, the parties are liberty to agitate their claim and rights before the learned Single Judge in the pending Civil Suit. (P.V.,J.)
