ORDER

(Order of the Court was made by Dr.G.Jayachandran J.) The petitioner herein, claiming ownership over Survey No.26/229/2, Adambakkam, Alandur Taluk, has given a complaint to the jurisdictional Inspector of Police on 21.06.2026, alleging that some third parties had created forged document and were attempting to grab the land. The present writ petition has been filed seeking a Mandamus to direct the Commissioner, Greater Chennai Corporation, the District Collector, Chengalpattu District, the Tahsildar and Deputy Tahsildar, Alandur Taluk, to consider her representation dated 21.06.2026.

2. As extracted from the record, the representation dated 21.06.2026 was addressed to the police. However, through this writ petition, the petitioner seeks its consideration by the Commissioner, Greater Chennai Corporation, and the jurisdictional revenue officials. On this ground alone, the writ petition is liable to be dismissed, as the representation was submitted to the police, but a Mandamus is sought against revenue and municipal authorities who have no knowledge of the said representation. That apart, the petitioner's claim of ownership over the land is highly disputed.

WP No. 37953 of 2026

3. The learned Special Government Pleader appearing for the respondents 2 to 4 submitted that the subject property is a vacant Government poramboke land. He states that the father-in-law of the petitioner had earlier filed a civil suit seeking injunction, which was subsequently dismissed. He further submitted that being a Government poramboke land, the Corporation identified the site for constructing a public toilet and the construction is under progress.

4. A perusal of the suit plaint filed by Ebinezer, the father-in-law of the petitioner, reveals an admission that the land is owned by the Government and no one except the Government can interfere with the enjoyment of the suit property. The suit was laid against the Commissioner of Alandur Municipality seeking an injunction and same has been dismissed for non-prosecution.

5. While so, in the complaint/representation dated 21.06.2026, addressed to the police, the petitioner claims ownership over the property and alleges third parties have fabricated the records to grab it. The inconsistency in the pleadings also warrants the dismissal of the writ petition.

6. Considering the facts and circumstance of the case, this Writ Petition stands dismissed. No costs. (Dr.G.J.,J.) (E.M.,J.) 29-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No rpl
