COMMON ORDER

(Made by P.Velmurugan J.) These writ petitions have been filed challenging the order passed by the first respondent viz., Intellectual Property Appellate Board, against the petitioner’s patents.

2. This Court, vide order dated 20.09.2013 made in W.P.Nos.17539 of 2011 and batch, has set aside the orders of revocation of patent issued by the first respondent and directed the first respondent to decide on the validity of the Board Resolution of the second respondent. The second respondent viz., Wind World (India) Ltd., had filed appeals before the Hon’ble Supreme Court and vide order dated 31.10.2013, the Hon’ble Supreme Court had granted an order of stay and admitted the case. As of now, the matter is pending before the Hon’ble Supreme Court in Civil Appeal Nos.3766 and 3777 of 2016.

3. Now, the learned Senior Counsel for the petitioners has produced a memo dated 29.09.2026, stating that the patents of petitioner in respect of these writ petitions have all expired and hence, nothing survives for further adjudication in these writ petitions.

4. Considering the submissions made by the learned Senior Counsel for the petitioners and the memo filed, this Court is of the view that, as the patents of the petitioners in respect of the subject matter of these writ petitions have expired, no further orders are necessary in these writ petitions.

5. Since the matter is pending before the Hon’ble Supreme Court in Civil Appeal Nos.3766 and 3777 of 2016, it is left open to the parties to agitate their respective rights with respect to the orders passed by the first respondent before the Hon’ble Supreme Court in the said Civil Appeals.
