Heard both sides.

2. Mr. C. Susikumar, learned Government Advocate (Criminal Side), takes notice for respondents 1 to 3 and Mr. P. Arumugam, learned counsel appearing for the 4th respondent.

3. The prayer in this writ petition is to direct the respondents 1 to 3, who are police officials, to take an appropriate action against the 4th respondent and recover the petitioner’s chit amount of Rs.3,20,000/-, based on the petitioner’s representation dated 17.12.2025.

4. This dispute is purely civil in nature and arises out of a chit transactions. Though the petitioner made an earlier compliant dated 04.10.2025 to the 2nd respondent, a CSR was issued on 04.10.2025. The CSR copy available in the typed set of paper reveals that the compliant was made for the recovery of chit amount.

WP Crl.(MD) No. 819 of 2026

5. As per the submission of both sides, when the CSR was closed, the 4th respondent agreed to settle the amount with the petitioner. If it is so, when the 4th respondent failed to pay that amount, the petitioner has to work out the appropriate remedy for recovery of amount.

6. Thereafter, the petitioner filed another complaint dated 17.12.2025, before the 1st respondent, seeking the same relief of to recover the amount otherwise to register a case for cheating against the 4th respondent. The idea behind the complaint is only for recovery of money and based on that this writ petition has been filed before this Court. The learned counsel for the 4th respondent was heard and he submitted that the entire amount has been settled.

7. These are factual disputes could be decided in a civil case. Therefore, while reserving the right of the petitioner, this writ petition is dismissed and the petitioner may work out for appropriate remedy for recovery of the amount before the competent Civil Court. 29-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No psm
