Order

The revision challenges the order passed in MP.No.1689 of 2024 pending the main MC No.584 of 2023.

2. By the impugned order, the petitioner was directed to pay Rs.25,000/- per month as interim maintenance pending the maintenance case. The Maintenance case was filed by the respondent claiming maintenance of Rs.60,000/- per month.

3. The learned counsel for the petitioner would submit that the evidence of the parties were recorded in the main maintenance case and the cross-examination of the respondent would reveal that the entire expenses of the respondent and their daughters, was borne by the petitioner; that the respondent had admitted in her cross-examination that a few properties were purchased in her name and in the name of their daughters; that the petitioner had paid for the educational expenses of their daughters, electricity bill and other expenses. The evidence also discloses that the petitioner also had spent money for the house hold articles of the respondent.

CRL RC No. 1312 of 2025

4. The learned counsel for the respondent however would submit that the trial Court had correctly considered the rival submissions and ordered the petitioner to pay Rs.25,000/- per month as interim maintenance, pending disposal of the maintenance case and no interference is called for.

5. It is seen from the impugned order dated 07.04.2025, the learned Magistrate did not have the benefit of the admissions made by the respondent in the cross-examination which was recorded on 06.07.2026. The cross-examination of the respondent reveals that the petitioner had taken care of the entire expenses of the daughters; that he had handed over his credit card to the daughters for their personal expenses; that the petitioner has purchased house hold articles for the respondent; that in fact, he had purchased a flat in the name of the respondent at Iyyapakkam and also built houses for the benefit of the daughters at Thirupathur and Iyyappanthangal.

6. When the revision was admitted, this Court had directed the petitioner to pay Rs.15,000/- per month which the petitioner is complying with. The respondent does not dispute this fact.

CRL RC No. 1312 of 2025

7. Considering the fact that the maintenance case is still pending and in the light of the admissions made by the respondent in the cross- examination, this Court is of the view that the amount of maintenance awarded by the Family Court can be reduced to Rs.15,000/- per month, pending disposal of the Maintenance Case No.584 of 2023.

8. The learned Family Judge may conclude the trial and dispose of the maintenance case in MC No.584 of 2023, as expeditiously as possible.

9. With the above modification, the Criminal Revision is partly- allowed. 28-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No ars
