ORDER

The Revision challenges the dismissal of the petitioner's application seeking return of his vehicle, which is said to be involved in Crime No.169 of 2026, registered for the offences under Sections 303(2) of BNS, 2023 and 21(1) of Mines and Minerals (Development and Regulation) Act, 1957.

CRL RC No. 2181 of 2026

2. The petitioner's prayer came to be rejected by the learned Magistrate on the ground that the vehicle was already involved in a similar offence while transporting m-sand and interim custody was handed over to the petitioner on the condition that he shall not use the vehicle for any illegal activities and yet the petitioner was found transporting sand in violation of the earlier condition.

3. This Court finds no infirmity whatsoever in the impugned order passed by the learned Magistrate.

4. Hence, the Revision is dismissed. 28-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No TSG To
