ORDER

The claimants-land owners are the revision petitioners, aggrieved by the award of compensation at the rate of Rs.10,000/- per sq.ft in LAOP.No.49 of 2015, by judgment and decree dated 16.03.2026, on the file of the VI Assistant City Civil Court, Chennai.

2. I have heard Mr.K.M.Venugopal, learned counsel for the revision petitioners and Mr.P.Sunil, learned Government Advocate for the respondents.

3. The revision arises out of a land acquisition proceedings initiated by the State under the Tamil Nadu Highways Act, 2001. Section 15(2) notification was issued on 16.12.2010 and Land Acquisition Officer awarded compensation of Rs.4,220/- per sq.ft. Dissatisfied with the same, the claimants approached the Reference Court and the Reference Court, by judgment and decree dated 16.03.2026, enhanced the compensation to Rs.10,000/- per sq.ft, together with the other attendant benefits.

4. Assailing the said award, the learned counsel for the petitioners would bring to my notice that in respect of adjoining lands acquired under the very same notification as against the compensation awarded, arrived at by the Land

CRP No. 6028 of 2026

Acquisition Officer at Rs.4,220/- per sq.ft, the neighbouring landowners had approached the Reference Court and compensation was enhanced to Rs.14,000/- per sq.ft. The said enhancement was challenged before this Court in CRP.No.2591 of 2025 at the instance of the respondents herein and by order dated 07.11.2025, I had affirmed the award of Rs.14,000/- per sq.ft, finding that there is no infirmity or illegality committed by the Reference Court. The present revision petitioner is also one of the land losers under the very same notification. Therefore, when the issue has already been decided and compensation has been fixed at Rs.14,000/- per sq.ft, the petitioners are naturally entitled to the same benefit and the award of Rs.10,000/- by the Reference Court has to be consequently modified and enhanced to Rs.14,000/- per sq.ft.

5. The grounds of attack by the respondents for seeking deduction from Rs.14,000/- per sq.ft were all tested in the said CRP, in fact, by me and I found that the Reference Court has given valid reasons for fixing the compensation at Rs.14,000/- per sq.ft. In such view of the matter, in the present case, the petitioners-claimants cannot be left isolated and a disparity be created amongst similarly placed land losers. For the foregoing reasons, the petitioner is entitled to enhancement.

6. In fine, the Civil Revision Petition is allowed and order dated 16.03.2026 in L.A.O.P.No.49 of 2015 on the file of the VI Assistant City Civil Judge, Chennai is set aside, enhancing the compensation from Rs.10,000/- per sq.ft to Rs.14,000/- per sq.ft, in line with the orders passed by this Court in a batch of revision petitions in CRP.Nos.2591, 2719, 2725 of 2025 on 07.11.2025 and CRP.No.1164 of 2026 on 06.03.2026. The additional benefits shall be calculated, on the basis of the compensation awarded at Rs.14,000/- per sq.ft instead of Rs.10,000/- per sq.ft and the same by the respondents to the petitioners, within a period of eight weeks from the date of receipt of a copy of this order.
