ORDER

Heard the learned counsel for the petitioner and the learned counsel for the respondents.

2. The revision petitioner is the tenant, who is aggrieved by the order of eviction passed by the Rent Court in RCLOP.No.32 of 2023 and confirmed in RLTA.No.12 of 2025.

3. Though the learned counsel for the petitioner brought to my notice that even at the earlier instance, the petitioner had filed counter stating that rents have been enhanced in 2017 and the same had been paid without any default upto the filing of RLTOP and pending RLTA, I do not find such unilateral statement being established by any piece of documentary evidence before the Rent Court or Tribunal.

4. Be that as it may, today, eviction has been ordered on the ground that there had been failure to enter into Rent Tenancy Agreement under Section 4(2) r/w section 21(2)(a) of Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017. There has been no written agreement as

required and mandated under Section 4 of the said new legislation. Hence, there is no infirmity in the order of the Rent Court and Rent Tribunal ordering eviction on the ground that there has been a failure to enter into agreement between the parties. I do not find any merit in the revision petition Hence, the Civil Revision Petition is dismissed.

5. At this juncture, the learned counsel for the petitioner prays for time till 31.03.2027 for vacating and handing over the vacant possession. The said request for time is stoutly opposed by the learned counsel for the respondent stating that the petitioner is in arrears of rent from March 2026 onwards. Even if the advance paid is adjusted, the arrears comes to Rs.3,13,750/- as on date.

6. Learned counsel for the petitioner would state that the petitioner is willing to clear the entire arrears by the end of December, 2026 and continue to pay the admitted rent for the months of October, 2026 to March,2027.

7. It is needles to state that the petitioner shall pay the admitted rent at the rate of Rs.6250/- per month from October, 2026 till March, 2027 in advance i.e., rent for October, 2026 shall be paid or or before the 10th of October, 2026 and so on and so forth. The petitioner shall file an affidavit of undertaking in this regard and also undertakes to vacate and handover vacant possession of the tenant premises peacefully on 31.03.2027 without dragging the

respondent/landlord to move the execution proceedings and also give an undertaking that the petitioner will not sublet or underlet the tenant premises to any third parties. The said affidavit shall be filed within a period of one week after serving a copy of the same to the counsel for the respondent.

8. With the above directions, the Civil Revision Petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed. 28-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No vsi
