ORDER

The present writ petition has been filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the respondent to sanction the pay bill and release the arrears of pay pursuant to the proceedings of the Joint Director of School Education issued in Moo.Moo.No.003959/L/E5/2022, dated 21.09.2022, as forwarded by the Headmaster, Government High School, Kandigai, Chengalpattu District.

2. The learned counsel for the petitioner would submit that the stepping up of pay of the petitioner has arisen on account of the pay anomaly arising out of the 7th Pay Commission, in G.O.Ms.No.234 dated 01.06.2009. It is the specific submission of the learned counsel for the petitioner that, though the authorities, namely, the Joint Director of School Education, have already passed proceedings giving stepping up of pay vide order dated 21.09.2022, the Treasury officials on insisting ratification from the Government have not sanctioned the amount.

3. The learned counsel for the petitioner would submit that this is not a stepping up of pay arising under Fundamental Rule 27(2), to have the concurrence of the Government, contrarily it arises under Rule 5(3) of the 2009 Rules.

WP No. 12869 of 2024

4. The learned counsel for the petitioner relies upon the judgment of the learned Single Judge in W.P.No.21543 of 2024 dated 16.08.2024, wherein this Court, after an elaborate discussion, arrived at a conclusion that if any stepping up of pay has arisen on account of the implementation of the Pay Commission, ratification of the Government is not required.

5. At this juncture, the learned Government Advocate appearing for the respondents would submit that the petitioner is entitled to have the benefits as ordered by the Joint Director of School Education vide proceedings dated 21.09.2022.

6. In view of the above fair submission made by the learned Government Advocate, the respondents are directed to settle the dues in accordance with the proceedings of the Joint Director of School Education dated 21.09.2022, without insisting upon any ratification from the State Government, within a period of eight weeks from the date of receipt of a copy of this order. Accordingly, this writ petition is disposed of. No costs. 28-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No JRS
