ORDER
The present writ petition has been filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the
WP No. 8299 of 2022
respondent to grant a sum of Rs.30 lakhs as compensation for not providing valid documentary proof for the settlement of the cash award for the campaign by way of a gift card and for the mental torture allegedly caused to the petitioner during the campaign period, resulting in high mental depression.
2. The party in person appeared through video conferencing mode and would submit that, if the respondent accepts the open challenge to the petitioner, then he is not interested in the claim amount made in the present writ petition. It is also his submission that, in spite of putting his full effort for getting the premium, the respondent has not given a gift card and they have also not responded to the RTI queries.
3. While looking into the affidavit, this Court is at a loss as to how the petitioner can seek for a mandamus for such a trivial issue. But, at this juncture, the learned counsel for the respondent would submit that, notwithstanding the above factual position, the issue pertains to the period of 2014. It is the submission of the learned Standing Counsel for the respondent that, for not furnishing the gift pack of the year 2014, the petitioner has started the issue by way of sending RTI letters from 2019 and has come up with the present writ petition.
4. It is the specific submission of the respondent that, if at all the petitioner requires any remedy, it cannot be by way of writ proceedings. Apart
WP No. 8299 of 2022
from that, this writ petition is devoid of merits and is hit by the principles of delay and latches.
5. I have given my anxious consideration to the submissions made on either side.
6. The sum and substance of the writ petition is that, by not providing the gift cost in the year 2014, the petitioner was deprived and such deprivation has caused mental stress. Therefore, for their inaction, the petitioner is entitled for a compensation of Rs.30 lakhs.
7. This Court is of the firm view that, for such a relief, no writ petition is maintainable, because it requires a trial in the nature of examination of witnesses and cross-examination. In a writ proceeding, such disputed facts cannot be decided. Furthermore, the issue commenced from 2014, whereas the present writ petition has been filed in the year 2022. In view of such delay also, the present writ petitioner cannot have any relief from this Court.
7. In view of the above, this Court does not find any merits in the writ petition. Accordingly, the writ petition is dismissed. No costs. 28-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No JRS
