JUDGMENT

(Judgment of the Court was delivered by S.M.Subramaniam J.) Writ Court, while dismissing the writ petition, made a finding that the maternity leave will have to be taken into account and it should be treated as if the employee who availed Maternity leave is deemed to be in service. Since writ petition has been filed only to dispose of the representation and on account of depth of necessary facts, learned Single Judge dismissed the writ petition.

2. However, if any right exist to the appellant, she is always at liberty to approach the appropriate authority. In respect of the eligibility of the appellant, it is to be considered in accordance with the Rules.

3. With these observations, writ appeal stands disposed of. No costs. Consequently, the miscellaneous petitions, if any, are closed. (S.M.S.,J.) (K.G.R.,J.) 25-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No GD
