ORDER

The present writ petition has been filed seeking issuance of writ of mandamus to direct certain amount arising out of some settlement.

2. The learned Standing Counsel for the respondents submitted that the petitioner was eligible for some amount and they would settle the eligible amount in accordance with appropriate rules and in accordance with law within a reasonable time.

3. In such view of the above submission, the respondents are directed to settle the eligible amount, in accordance with Section 12(3) of Industrial Disputes Act, 1947 settlement, within a period of four weeks from the date of receipt of a copy of this order, along with interest at the rate of 6% per annum from the date of retirement till the date of disbursal.

4. Apart from that, in the writ petition, the petitioner has also seek for an interest upon the belated payment of gratuity and leave salary which has already been settled. As rightly contended by the learned counsel for the petitioner, when there is a delay on the part of the respondents, the employees are entitled to have an interest. Therefore, if such amount is settled to the petitioner without any interest, the respondents are directed to pay the interest even for the gratuity and leave salary at the rate of 6% per annum from the date of retirement till the date of disbursal.
