ORDER

(Order of the Court was made by P.Velmurugan J.) This Writ Petition is filed seeking to quash the impugned order of demolition in Na.Ka.No.874/2025/A7 dated 08.09.2025 passed by the third respondent.

According to learned counsel appearing for the writ petitioner, the petitioner is in long-standing possession of the subject property for more than two generations and have been paying property tax and electricity charges for several years. That being so, the fourth respondent claiming right over the property applied for patta and complained before the revenue officials seeking for removal of the alleged unauthorised construction. The fourth respondent also filed Writ Petition in W.P.No.16650 of 2025 and this Court disposed of the same by directing the third respondent to consider the fourth respondent’s representation and pass appropriate orders. Thereafter enquiry was conducted and the third respondent by proceedings dated 18.03.2026 in Na.Ka.No.0874/2025/A6, rejected the claim of the fourth respondent and directed the parties to approach the Civil Court. Thereafter the third respondent again summoned the petitioner and since the petitioner could not attend the hearing on the date fixed by the third respondent, attempted to appear on 31.08.2026 and as the third respondent was not available, the petitioner submitted his detailed explanation with supporting documents. The third respondent, without considering the same, passed the impugned order, which is liable to be quashed.

Mr.B.Sivakollappan, learned Additional Government Pleader appearing for the respondents 1 and 2 and Mr.AR.Balaji, learned Government Advocate for the third respondent made a submissions justifying the issuance of the impugned order by the third respondent. Further they have stated that the erstwhile Village Panchayat President has been removed and the new President assumed office very recently and hence the order of demotion could not be implemented as scheduled.

Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents 1 & 2 and the learned Government Advocate for the third respondent and perused the materials available on record.

It is seen that the petitioner has made unauthorised construction without any proper documents. Therefore the third respondent has issued proceedings dated 08.09.2026 for demolition of unauthorised construction made by the writ petitioner.

A perusal of the records shows that the petitioner was provided with sufficient opportunities before passing the impugned proceedings and therefore we find no reason to interfere with the impugned order.

Accordingly the Writ Petition shall stand dismissed. Consequently connected miscellaneous petitions are closed. No costs. (P.V.,J.) (G.K.M.,J.) 25-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No cgi To
