ORDER

This petition has been filed for issuance of Writ of Mandamus, to call for the records pertaining to the impugned order passed by the 2nd respondent in Na.Ka.No.27/Camp/Ka.Vu.Aa/Ma.Ma/2026 dated 18.09.2026 and quash the same and consequently directing the 2nd respondent to give permission to the petitioner to organize Adal Padal Program on 28.09.2026 from 07.00 p.m to 10.30 p.m at Arulmigu Sri Pechiyamman Temple. Mr.D.Rajaboopathy, learned Government Advocate, (Crl. Side) takes notice for the respondents. Heard the counsel on either side and perused the records.

2. When the matter was taken up for hearing today, the learned

WP.Crl.(MD)No.5365 of 2026 counsel appearing for the petitioner submitted that the petitioner's request to conduct an "Aadal Padal" cultural program scheduled for 28.09.2026 between 07:00 PM and 10:00 PM was rejected by the second respondent, and the said order of rejection is under challenge in this Writ Petition.

3. The learned Government Advocate (Criminal Side) appearing for the respondents submitted that the petitioner has not obtained or produced the requisite No Objection Certificates (NOCs) from various concerned departments. He further submitted that the proposed venue is situated on a narrow street, and a prohibitory order issued by the Commissioner of Police, Madurai City, under Sections 41 & 41A of the Tamil Nadu City Police Act, 1988, is currently in force. Hence, the petitioner's request was rejected. However, he submitted that if the petitioner comes forward with a request for an alternative program, a fresh representation may be submitted, which will be considered in accordance with law.

4. In response, the learned counsel for the petitioner submitted that instead of an "Aadal Padal" program, the petitioner may be permitted to submit a fresh representation to conduct a traditional "Gramiya Padal"

WP.Crl.(MD)No.5365 of 2026 program, without any obscene or vulgar dance performances.

5. Considering the rival submissions and the fair stand taken by both sides, this Court disposes of the Writ Petition with the following directions:

(i) The petitioner is at liberty to submit a fresh representation to the second respondent seeking permission to conduct a "Gramiya Padal" program instead of the "Aadal Padal" program.

(ii) On receipt of such fresh representation, the second respondent shall consider the same positively and pass appropriate orders regarding permission and police protection.

(iii) The respondents shall strictly monitor the program. If any obscenity, vulgarity, or obscene dance takes place during the performance, the respondent police are directed to immediately stop the program and initiate strict legal action against the organizers.

6. With the above directions, this Writ Petition stands disposed of. 25.09.2026 TM
