ORDER

The present writ Petition has been filed seeking a direction to respondents 1 and 2 (police officials) to take necessary action based on the petitioner's

WP Crl.(MD) No. 5367 of 2026

representation dated 20.07.2026 and to recover a sum of Rs.12,00,000/-.

2. The facts of the case reveal that the petitioner paid a sum of Rs.12,00,000/- to private individuals namely, Kasturi, and Perumal, to secure a government job through illegal means. The said individuals issued a fraudulent appointment order to the petitioner. Upon realizing that he had been cheated, the petitioner lodged a police complaint seeking criminal action against the accused persons as well as recovery of the sum of Rs.12,00,000/- paid as illegal gratification/bribe.

3. As the respondent police allegedly failed to act on the complaint, the petitioner has approached this Court, seeking a direction to register the complaint and recover the paid consideration.

4. It is a well-settled principle of law, recently reaffirmed by the Hon'ble Supreme Court, that Courts of law cannot act as recovery forums for illegal gratification or money exchanged in corruption schemes. Courts are established for public justice, not to facilitate the recovery of illegal consideration paid to commit an unlawful act. Seeking directions for police action to recover bribe money paid for securing public employment through unlawful means is a complete abuse of the judicial process, consuming valuable court time.

WP Crl.(MD) No. 5367 of 2026

5. In view of the above observations, this Court finds no merit in the petition, and the prayer seeking recovery of money paid as illegal consideration cannot be entertained in the form of a Writ Petition.

6. Accordingly, this Writ Petition is dismissed on merits. 25-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No TM To
