ORDER

Heard learned counsel for the petitioner and Mr.R.Thiyagarajan, learned counsel undertakes to file vakalat on behalf of the respondent/landlord.

CRP No. 6109 of 2026

2. The learned counsel for the petitioner would submit that as against the order of recovery of possession RLTOP. No.3 of 2023, an appeal has been filed in RLTA. No.13 of 2025, since the Rent Tribunal is the Subordinate Court viz., IV Additional District and Sessions Court, Ponneri, Tiruvallur and there has been repeated Advocate boycotts is the designating Rent Tribunal before the RLTA No.13 of 2025, is pending. Admittedly, there is no interim stay granted in the Rent Tribunal. However, it is the contention of the learned counsel for the petitioner that the petitioner has already filed I.A. No.1 of 2025, for stay, which has not been disposed of for last several months and the reasons assigned by the learned counsel for the petitioner is that there has been repeated Advocate boycotts in the said Court, which resulted in the Application and the Appeal not being taken, the learned counsel for the petitioner would therefore prays for some interim relief and he is willing to co-opearate for the expeditious disposal of the RLTA.

3. Per contra, learned counsel for the respondent/landlord states that the petitioner has not been successful in obtaining even an exparte order of stay, as against the order of eviction in RLTOP No.3 of 2023 and it is the petitioner who has not been ready to argue the appeal and has been dragging the matter by taking some application or the other.

CRP No. 6109 of 2026

4. The learned counsel for the petitioner however states that excepting I.A. No.1 of 2025, it is for interim stay, there is no other Interlocutory Application pending to be taken along with RLTA.No.13 of 2025. In the light of the above, considering that the appeal is ripe for argument, I am inclined to dispose of the revision on the following terms:- The RLTA No.13 of 2025, shall be disposed of by the Rent Tribunal/IV Additional District and Sessions Court, Ponneri, within a period of four weeks from the date of receipt of the copy of the order. Till then, the Execution Proceedings shall be kept in abeyance, subject to the result of RLTA, it shall be open to the respondent to execute the decree, if any in his favour. No costs. Consequently, connected Miscellaneous Petition is also closed. 24-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No RKP To The Additional District and Sessions Judge-IV, Ponneri,
