COMMON ORDER

These civil revision petitions are filed against the order dated 02.06.2026, 02.04.2026 and 20.05.2026 respectively passed in I.A.Nos.16, 19 and 20 of 2025 in HMOP.No. 319/2023 by the Family Court, Tuticorin.

2. The petitioner is the husband and the respondent is the wife. The marriage between the petitioner and the respondent was solemnized on 03.04.2022. After the marriage, matrimonial disputes arose between them, due to which the respondent left the matrimonial home on 01.08.2022. Thereafter, the respondent filed H.M.O.P. No. 319 of 2023 before the Family Court, Tuticorin, seeking dissolution of the marriage by a decree of divorce. Subsequently, the respondent filed I.A. No. 6 of 2024 seeking interim maintenance.

3. When the matter was taken up for hearing today, the petitioner appeared before this Court in person, while the respondent appeared through video conferencing. The respondent submitted that she is willing to dissolve the marriage without making any claim against the petitioner, subject to the condition that the petitioner withdraws all the criminal complaints lodged against her. She further undertook to withdraw all the complaints filed by her against the petitioner.

4. In the meantime, both the parties shall enter into a compromise memo and file the same before the Trial Court. Since both the parties have agreed to resolve the matrimonial dispute amicably and have undertaken not to interfere with or disturb each other hereafter, this Court directs both the parties to file an appropriate petition before the Trial Court seeking dissolution of their marriage by mutual consent. Upon receipt of such petition, the Trial Court shall consider the same in accordance with law and, subject to compliance with the statutory requirements, pass appropriate orders without insisting upon any unnecessary waiting period, since the parties have been living separately for a considerable length of time.

5. With this observation, these Civil Revision Petitions stand closed. No costs. Consequently, connected miscellaneous petitions are closed. 24.09.2026 NCC : Yes / No Index : Yes / No Ns
