ORDER
This Civil Revision Petition has been filed by the revision petitioner to expedite the disposal of the I.D.O.P. No. 993 of 2025 on the file of the Family Court, Padmanabhapuram.
2. The learned counsel for the petitioner states that originally the petitioner filed IDOP.No.342 of 2011 before the District Court, Kanyakumari at Nagercoil for divorce. Thereafter, the above petition was transferred to the Family Court, Nagercoil and renumbered as IDOP. No.102 of 2012 and then again it was transferred to Padmanabhapuram and renumbered as IDOP.No.993 of 2025.
3. He further states that initially the petitioner was called absent and thereafter, the divorce petition was dismissed for non- compliance of the order to deposit half of the interim alimony already ordered by the trial Court. Against which, the petitioner filed CMA. (MD)No.530 of 2017 before this Court and this Court allowed the petition and directed the trial Court to conclude the trial and dispose of the case within a period of three months from the date of order, namely, 08.10.2021. Subsequently, in view of the transfer of the above case, it could not be concluded. Now the trial has been commenced and the petitioner was also examined as PW1 and now the case is posted for cross examination. The petitioner is working as Jawan at Arunachalapradesh, he is an Army man and the case is pending for more than 14 years and the respondent is taking advantage of the pendency of the case, filing petition after petition and she is not cooperating for disposing the divorce petition. Therefore, the matter is pending without any further progress. Hence, he prayed to issue a direction to the trial Court for speedy disposal.
3. Heard the learned counsel for the petitioner and perused the materials available on record.
4. On perusal of records, it is seen that the divorce petition is pending for more than 10 years and ‘B’ diary also shows that the trial has been commenced. Since the petitioner is working in the Army, and in order to give a quietus to the old case i.e., more than 10 years old case, this Court is of the view that the matter has been pending at the stage of cross examination of PW1, considering the request made by the petitioner, this Court directs the Family Court, Padmanabhapuram, to conclude the trial and dispose of the IDOP.No.993 of 2025, after providing an opportunity to both the parties, on its own merits and in accordance with law.
5. Accordingly, this Civil Revision Petition is disposed of with a direction to the Family Court, Padmanabhapuram, to dispose of the IDOP.No.993 of 2025, after providing an opportunity to both the parties, on its own merits and in accordance with law, as early as possible, preferably, within a period of six months from the date of receipt of a copy of this order. No costs.
