Judgment

(Judgment of the Court was delivered by S.M.Subramaniam J.) State preferred the present intra court appeal challenging the writ order dated 13.06.2024 in W.P.No.11867 of 2015 mainly on the ground that the writ Court ordered 12% interest per annum for the belated settlement of leave encashment salary, special GPF and pension arrears.

2. As per the Pension Rules, an employee is entitled for interest at the rate of 8% per annum for the belated settlement of Gratuity and Provident Fund. However, granting 12% interest per annum is over and above the interest contemplated under the Tamil Nadu Pension Rules.

3. Learned counsel appearing for the employee would submit that interest was granted by the writ court as the retirement benefits were settled belatedly and hence the writ appeal is to be rejected.

4. This Court is of the considered view that once Tamil Nadu Pension Rules contemplates the rate of interest to be paid for the belated settlement of terminal benefits, that is to be followed and High Court enhancing the interest is unnecessary. Learned Additional Government Pleader would submit that

the rate of interest contemplated under the Pension Rules is 8% and therefore the writ order impugned is to be modified.

5. In view of the facts and circumstances, the appellant is directed to grant 8% interest per annum under rule 45A of the Tamil Nadu Pension Rules 1978 for the belated settlement of terminal and pensionary benefits due to the respondent. Interest is to be calculated for the delay period and accordingly directed to be settled within a period of 12 weeks from the date of receipt of a copy of this order. The writ appeal stands disposed of accordingly. No costs. Consequently, connected miscellaneous petition is closed. (S.M.S.,J.)
