ORDER

On perusal of the cause list, it is seen that, though the 1st respondent/General Manager, Indian Bank, the 2nd respondent/Assistant General Manager, HRM Department, and the 4th respondent/Branch Manager, Edaikazhindu Branch, Indian Bank, have been duly served and their names are printed in the cause list, none appeared before this Court and there is also no representation on their behalf.

2. The prayer sought for in the present Writ Petition is for a direction to the 2nd respondent Bank to grant compassionate allowance to the petitioner in terms of Regulation 31(1) of the Pension Scheme Regulations. In this regard, the petitioner had submitted a representation dated 15.10.2015 to the 3rd respondent.

3. Since the said representation is of the year 2015 and was addressed to the 3rd respondent, who has not been served with notice, and since the relief sought for in the present Writ Petition is against the 2nd respondent, instead of directing the 3rd respondent to consider the representation dated 15.10.2015, this

WP No. 32076 of 2022

Court is inclined to direct the petitioner to submit a fresh representation to the 2nd respondent.

4. Accordingly, the petitioner is directed to submit a fresh representation to the 2nd respondent, along with a copy of the representation dated 15.10.2015 and a copy of this order, within a period of two weeks from the date of receipt of a copy of this order. If such representation is received by the 2nd respondent within the aforesaid period, the 2nd respondent shall consider the same on its own merits and in accordance with law and pass appropriate orders within a further period of eight weeks thereafter.

5. With the above direction, this Writ Petition is disposed of. No costs. Consequently, the connected miscellaneous petition is closed. 24-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No JRS
