ORDER
The present Writ Petition has been filed seeking consideration of the petitioner based upon the marks secured by her in the examination conducted by the Teachers Recruitment Board pursuant to Notification No.01/2021 dated 09.09.2021.
2. It is the contention of the petitioner that she participated in the recruitment process for the post of P.G. Assistant and secured 96.505086 marks and that she belongs to the SC category. It is also her contention that, according to the notification, the cut-off mark for candidates belonging to the SC category was 68. Since the petitioner had secured marks higher than the said cut-off mark, she claims that she is eligible to be considered for selection.
3. However, the said contention was stoutly objected to by the learned Standing Counsel appearing for the Teachers Recruitment Board. The learned Standing Counsel would contend that the petitioner had secured only 96.505086 marks, whereas the cut-off mark prescribed for candidates to be called for certificate verification under the SC category was 101.810896. Since the petitioner had not secured the requisite cut-off mark for being considered for selection, as per the provisional selection list dated 14.10.2022, she cannot seek any relief before this Court.
WP No. 34146 of 2022
4. The learned Standing Counsel appearing for the Teachers Recruitment Board would further submit that, as per the provisional selection list dated 14.10.2022, the cut-off marks were 105.8153 for SC-G, 106.8164 for SC-W, 106.8164 for SC-T, 107.8175 for GT and 107.8175 for GT-W. Hence, the learned Standing Counsel would pray for dismissal of the Writ Petition.
5. I have given anxious consideration to the submissions made by the learned counsel appearing on either side.
6. The main contention put forth by the learned counsel for the petitioner is that the petitioner has secured the required cut-off mark for the post of P.G. Assistant. However, in paragraph No.10 of the counter affidavit, the respondent has taken the following stand: “10. It is submitted that the petitioner secured only 96.505086 marks. Whereas, the minimum eligible cut-off marks for Certificate Verification as per the list of shortlisted candidates for Certificate verification published on 28.08.2022 under SC was 101.810896, she has not been called for Certificate Verification and the minimum eligible cut off marks for selection as per the provisional Selection List dated 14.10.2022 under SC G-105.8153, SC-W-106.8164 and SC T- 106.8164; GT -107.8175 and GTW -107.8175..”
WP No. 34146 of 2022
7. According to the above stand, the petitioner did not come within the zone of consideration for certificate verification, as she had secured only 96.505086 marks, whereas the required mark for being shortlisted for certificate verification under the SC category was 101.810896.
8. At this juncture, the learned counsel for the petitioner would submit that, even according to the notification, the minimum qualifying mark was
68. However, the mere securing of the minimum qualifying mark does not confer any right upon the petitioner to claim selection. Once the recruitment process proceeds to the stage of certificate verification, the recruiting agency is entitled to fix the cut-off mark for shortlisting candidates, depending upon the number of vacancies and the number of candidates available for consideration.
9. The mere fact that the petitioner has secured the minimum qualifying mark prescribed in the notification would not, by itself, entitle her to be called for certificate verification or to claim selection to the post. The minimum qualifying mark only enables a candidate to participate further in the selection process, subject to the cut-off mark fixed for shortlisting candidates at the subsequent stage.
WP No. 34146 of 2022
10. In view of the above factual position, this Court does not find any merit in the present Writ Petition. Accordingly, this Writ Petition is dismissed. No costs. The connected miscellaneous petition is also closed. 24-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No JRS To
