O R D E R

(Order of the Court was made by P.Velmurugan J.) This Writ Petition has been filed seeking issuance of a writ of mandamus directing the respondents to consider the petitioner’s representation dated 16.05.2026 and to remove the alleged encroachments in the Government Poromboke land comprised in S.No.229/6, Soolaimeni Village, Uthukottai Taluk, Tiruvallur District, within a time frame to be fixed by this Court.

2. Mr.K.Surendar, learned Special Government Pleader, accepts notice for the respondents. With the consent of both the parties, the writ petition is taken up for final disposal at the admission stage itself.

3. Learned counsel for the petitioner submitted that the land in S.No.229/6, measuring an extent of 0.15 cents, is classified as Government Poramboke and has been used by the villagers as a common playground for children. It is alleged that certain persons, with political influence, have encroached the said land and put up unauthorized constructions. It is further submitted that the alleged encroachers have applied for patta in their favour and that the authorities are taking steps to grant patta in respect of the said land. Despite objections raised by the villagers and the representation submitted by the petitioner, no effective action has been taken, necessitating the filing of the present writ petition.

4. The Special Government Pleader appearing for the respondents, on instructions, submitted that the Government has initiated a proposal for allotment of the said land to landless poor persons for residential purposes and for issuance of patta in their favour, and that the said proposal is presently under consideration.

5. Heard both sides.

6. Admittedly, the land in question is classified as Government Poramboke. The submission of the learned Special Government Pleader is that the Government has already initiated steps to allot the said land to the landless poor persons, who are genuinely in need of residential sites, is recorded.

7. In view of the above submission, no further direction is required in the present writ petition. However, it is made clear that any allotment or grant of patta shall be made strictly in accordance with the applicable rules and after duly verifying the eligibility of the beneficiaries. The respondents shall also ensure that no patta is granted merely on the basis of political influence or to persons who are otherwise ineligible under the applicable rules. In the event of any allotment or grant of patta being made contrary to law or in favour of persons who are ineligible, it is open to the petitioner to work out his remedy in the manner known to law.

8. This Writ Petition stands disposed of accordingly. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed. (P.V.,J.) (G.K.M.,J.) 24-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No ms To
