ORDER

This Civil Revision Petition has been filed by the revision petitioner against the order dated 31.07.2026 passed in IA.No.1 of 2025

( Uploaded on: 01/10/2026 03:33:18 pm )

C.R.P(MD)No.2621 of 2026 in OS No.69 of 2024 on the file of the Family Court, Madurai.

2. The petitioner is the husband. The respondent is the wife. The respondent/wife filed a suit for restitution of conjugal rights under Mohammedan Law, since the parties are Muslims. During the pendency of the suit, the respondent filed a petition in IA.No.1 of 2025 with a prayer to grant a sum of Rs.10,000/- towards interim maintenance for herself and medical expenditure. The trial Court allowed the petition and granted a sum of Rs.10,000/- towards interim maintenance. Against which the present civil revision petition is filed by the petitioner/husband by stating that he is only deriving a sum of Rs.21,000/- per month as a Lab Technician and out of the said amount, he has to pay the loan amount, as he has already obtained a sum of Rs.7,00,000/- loan from a private concern and hence, the interim maintenance granted to the respondent/wife is exorbitant and prayed to modify the amount.

3. The learned counsel for the petitioner states that the petitioner is working as a Lab Technician and is now earning a sum of Rs.25,000/- and after deductions he is receiving only a sum of Rs.18,000/-

C.R.P(MD)No.2621 of 2026 per month and hence, prayed to reduce the interim maintenance. But he has not produced his salary certificate.

4. Taking into consideration the petitioner's plea and on perusal of the records, it is seen that the respondent/wife has to meet her medical expenses and continuously deserted the petitioner and further the revision petitioner also filed a divorce petition against the respondent/wife, the trial Court has granted only a meager amount of Rs.10,000/- which is very moderate amount and that cannot be reduced and there is no ground to set aside the order passed by the trial Court. The petitioner is here by directed to pay the entire amount immediately without any delay.

5. Accordingly, this civil revision petition is dismissed in admission stage. No costs. Consequently, connected miscellaneous petition is closed.
