ORDER

The present Civil Revision Petition has been filed seeking a direction to the learned V Additional District Court, Madurai, to expedite the hearing of O.S. No. 112 of 2024 and dispose of the same, preferably within a stipulated time.

2. The revision petitioner is the 11th defendant, and the first respondent is the plaintiff in O.S. No. 112 of 2024 on the file of the learned V Additional District Court, Madurai, instituted for partition and separate possession.

3. It is the contention of the revision petitioner that the first respondent/plaintiff instituted the suit without impleading the revision petitioner as a party defendant. Subsequently, the revision petitioner filed an appropriate application seeking to implead himself as a party to the suit, and the said application was allowed by the Trial Court. It is further contended that, despite the suit being pending before the Trial Court, the first respondent/plaintiff has not taken effective steps to proceed with the matter and has been prolonging the proceedings. Therefore, the revision petitioner has approached this Court seeking a direction to the learned V Additional District Court, Madurai, to expedite the trial and dispose of O.S. No. 112 of 2024 at the earliest. In support of his contention regarding the stage of the proceedings, the revision petitioner has also produced the B-Diary extract before this Court.

4. On perusal of the B diary, ti is seen that several I.As are pending before the trial Court. At present, I.A.Nos.5 and 6 of 2026, relating to the petition for major declaration and the petition for removal of the guardian, respectively, are pending. In the said I.As, the trial Court has ordered notice and directed the parties to file their counters, and the matter has been posted on 25.08.2026.

5. In the above circumstances, this Court cannot issue a direction to the trial Court to dispose of the suit within a stipulated time. However, this Court requests the trial Court to take up and dispose of the pending interim applications at the earliest and thereafter proceed with the suit and make every endeavour to dispose of the same as expeditiously as possible.

6. With the above direction, this Civil Revision Petition stands disposed of. No costs. 23.09.2026 NCC : Yes / No Index : Yes / No Ns
