JUDGMENT

(Judgment of the Court was delivered by S.M.Subramaniam J.) The present Writ Appeal has been instituted challenging the Writ Order dated 29.09.2023 passed in W.P.No.7383 of 2020. Writ Petition was dismissed by the Learned Single Judge.

2. Learned Counsel for the appellant would mainly contend that though the appellant was employed in Government service on 15.07.2003, he was temporarily appointed and he was permanently absorbed only in the year 2010. Therefore, application seeking alteration of date of birth was filed within a period of 5 years.

3. Birth Certificate issued by the Sub-Registrar in the year 2017 cannot be trusted upon to ascertain the actual and correct date of birth of a person. Such certificates are issued based on the application submitted by the person concerned. Therefore, the said Birth Certificate issued in the year 2017 cannot be construed as conclusive proof for establishing the date of birth. Pertinently, appellant served and retired from Government service on 30.04.2020, and already 6 years have lapsed. Applications seeking alteration of date of birth after several years

WA No. 1671 of 2024

are not entertainable. In those days, in the absence of practice regarding registration of births, there are possibilities of variations to some extent. After long years, such variations, if allowed to be corrected, it will result in larger repercussions. Learned Single Judge also found that the application was submitted belatedly and that appellant has already retired from service in the year 2020.

4. For all these reasons, this Court is not inclined to entertain the Writ Appeal and the same is liable to be dismissed. Accordingly, the impugned order made in WP.No.7383 of 2020 dated 29.09.2023 is confirmed and the Writ Appeal stands dismissed. No costs. Consequently, the connected miscellaneous petitions, if any, are closed. (S.M.S.,J.) (K.G.R.,J.) 23-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No GD
