JUDGMENT

(Judgment of the Court was delivered by S.M.Subramaniam J.) The writ petitioner is the appellant and the appellant claims to be the second wife of Mr.Rajendran, who served as a First Grade Assistant Engineer in the Electricity Board. The deceased employee married one Smt.Rani as his first wife and gave birth to two children. The name of his first wife Smt.Rani has been entered in the service records as his legally wedded wife. However, the appellant claims that the first wife got separated from the employee and the deceased Rajendran married the appellant as his second wife.

2. Even in such circumstances, the marriage is to be construed as invalid as there was no valid dissolution of marriage obtained by the deceased employee with his first wife Smt.Rani. In the absence of any legal divorce, the second wife cannot claim family pension in view of the Pension Rules. The issues relating to the grant of family pension, in the context of Tamil Nadu Pension Rules 1978, more specifically, Rule 49, has been elaborately considered by this Court in the case of Accountant General of Tamil Nadu Vs.M.Radhakrishnan1. The learned Single Judge also rightly formed an opinion that the second wife is not entitled for family pension. 1(2026 MHC 388)

3. Thus, this Court is not inclined to entertain the present appeal. Consequently, the writ appeal stands dismissed. No costs. (S.M.S.,J.) (K.G.R.,J.) 23-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No SLI To
