O R D E R

1. Heard Mr. Namit Saxena, learned counsel for the petitioner and Mr. Kshitij Mittal, learned counsel for the State.

2. The present petition calls in question the correctness of the order dated 13-08-2026 in SBCRMBA No. 10062/2026 passed by the High Court of Judicature Digitally signed by NIRMALA NEGI Date: 2026.10.28 17:35:55 IST

Reason:

Signature Not Verified for Rajasthan at Jaipur. By the said order, the petitioner has been denied the benefit of bail in connection with FIR No.349/2021 registered with Karghani/Kardhani Police Station, Jaipur West, Rajasthan, for the offences punishable under Sections 498A, 406, 384, 302 and 120-B of the Indian Penal Code, 1860(for short, ‘IPC’). After investigation, the petitioner was charge-sheeted under Sections 498-A & 306 of the IPC by charge sheet No.135/2026 dated 02.07.2026.

3. Learned counsel for the petitioner submits that the deceased had died on 07.03.2021 and the FIR was registered on 20.04.2021 after delay of nearly 44 days; that the marriage was of 2008 and the death was 13 years after; that the Sections invoked are 498A & 306 of the IPC; that the petitioner has been in custody since 12.06.2026 and even though the FIR was filed on 20.04.2021, there was no interim protection till 04.12.2023, the petitioner was not taken into custody.

4. Learned counsel for the State, however, vehemently opposes the bail prayer of the petitioner.

5. Considering overall facts and circumstances of the case; having perused the records and the period already undergone by the petitioner, we are inclined to enlarge the petitioner on bail pending trial.

6. Accordingly, we direct that petitioner shall be enlarged on bail pending trial, subject to the satisfaction of the concerned Trial Court in connection with the aforesaid charge sheet/FIR and for the offences mentioned hereinabove.

7. The Special Leave Petition is disposed of in the above terms.

8. Pending application(s), if any, shall also stand disposed of. (NIRMALA NEGI) (NIKITA SINGH) ASTT. REGISTRAR-cum-PS COURT MASTER (NSH)
