ORDER
(Order of the Court was made by P.Velmurugan J.) The writ petitioner has filed the present writ petition seeking to quash the Form-III Notice dated 10.09.2026 issued under Section 56(2-A) of the Tamil Nadu Town and Country Planning Act, by the third respondent, whereby the petitioner was directed to demolish the unauthorised construction within a period of 10 days.
It is seen that the petitioner was served Form-I notice dated 17.07.2026 calling upon the petitioner to submit relevant documents regarding alleged unauthorised construction. The petitioner also submitted the documents and thereafter the petitioner was served Form-II Notice dated 04.08.2026 and the premises was inspected. Finding unauthorised construction put up, the petitioner was further served with Form-III Notice of demolition dated 10.09.2026.
According to learned counsel for the petitioner the writ petitioner is running a proprietary firm namely Jayashri Polymers for more than 15 years and is doing business in the nature of plastic moulding, plastic precision components

and plastic products in the alleged premisses and to move the same to another place, the writ petitioner needs some more time, as the time of 10 days granted by the respondents would not at all suffice for the petitioner to move his factory to another place.
This Court, when the matter was heard on the last occasion, directed the petitioner to file an affidavit to vacate the premises within two months. Accordingly the petitioner filed an affidavit dated 23.09.2026, wherein he agreed and undertook to vacate the premises within a period of two months.
In view of the above, the Writ Petitioner is granted time for a period of two months from the date of receipt of the copy of this order to vacate the premises. Till such time the respondents shall not take any coercive action against the petitioner and the alleged premises.
