O R D E R
1. Leave granted.
2. Given the fact that the appellant, Mohan Singh alias Babu Ram, is now aged over 83 years and the offence in relation to which he was convicted was his first and only offence, we are inclined to extend the benefit of Section 3 of the Probation of Offenders Act, 1958, to him and let him off with an admonition.
3. The sentence of imprisonment for one year visited upon the appellant is, accordingly, set aside and the appeal is allowed to that extent.
