1. During the pendency of this case, the parties were referred to the Supreme Court Mediation Centre to explore the possibility of an amicable settlement of their disputes. Pursuant to the efforts made by the learned Mediator, the parties settled their differences and reduced the terms of their compromise to writing, vide Settlement Agreement dated 12.12.2025. Pursuant thereto, they have now filed joint applications in I.A. Nos. 169425/2026 and 119511/2026, seeking appropriate directions from this Court.
2. The parties got married on 10.12.2017 but they have been living separately since May, 2022. Their daughter is still a minor.
3. In terms of the Settlement Agreement, the respondent-husband agreed to pay a sum of 35,00,000/- (Rupees thirty five lakhs ₹ only) to the petitioner-wife in full and final settlement of all her claims. We are informed by the learned counsel appearing for the parties that the total amount as on date has

been paid to the petitioner-wife. Mr. Siddharth Anil Khanna, learned counsel, appearing for the petitioner-wife, confirms that she has received the full amount.
4. We may note that, though the parties included a clause in the Settlement Agreement that the payment made by the respondent- husband would settle all the daughter’s claims also, we are not willing to accept the same. The rights of the daughter as against her father, be it in relation to her share in his ancestral property or for her own maintenance and education, shall not be affected by the Settlement Agreement between her parents. Though it would be open to the mother to use part of the settlement amount for the betterment of her daughter’s future, however, the same shall not preclude the daughter from asserting her rights against her father at an appropriate stage.
5. The parties having been living apart since May, 2022, and in the light of the settlement of the disputes by and between them, we find no reason to prolong their marital relationship or keep the litigation initiated by them pending. We, accordingly, exercise our jurisdiction under Article 142 of the Constitution of India, and dissolve the marriage performed by and between them on 10.12.2017.
6. The following proceedings pending between the parties shall be treated as dismissed/quashed/disposed of: i. Case bearing No. CRMAJ/10795/2023, titled “Parvati vs. Jagdeep Lohan”, pending before the Family Court, Surat, Gujarat. ii. The parties shall be bound by the terms of the Settlement Agreement and shall abide by them scrupulously and with all sincerity.
8. In the event of breach of any of the terms of the Settlement Agreement, the party aggrieved thereby is at liberty to seek specific performance thereof before the appropriate forum in accordance with law.
