ORDER

1. We have heard learned counsel for the parties.

2. Delay condoned.

3. This Miscellaneous Application has been filed by the applicant-Respondent No.1, i.e. the Oriental Insurance Co. Ltd., for clarification of the final order dated 20.04.2026 passed by this Court while allowing Civil Appeal No(s).4596-4597 of 2026, preferred by appellant Mukesh Singh.

4. Appellant, as the claimant, had preferred a claim petition before the Motor Accident Claims Tribunal for the injury suffered by him in a motor vehicular accident.

5. By the judgment and award dated 30.05.2013, the

Motor Accident Claims Tribunal awarded a compensation of Rs.10,61,120/- to the appellant.

6. Seeking enhancement of compensation, appellant approached the High Court by filing an appeal. High Court vide the order dated 18.09.2013 dismissed the said appeal.

7. Aggrieved thereby, appellant filed Special Leave Petition (Criminal) No(s).14125-14126 of 2026 before this Court.

8. On 21.11.2025, this Court had issued notice on the Special Leave Petition(s) as well as on the Interlocutory Application for condonation of delay. It was made clear that in the event delay was condoned and compensation was enhanced, appellant would not be entitled to receive interest for the period of delay.

9. Subsequently, on leave being granted, this Court vide order dated 20.04.2026, allowed the two appeals and enhanced the compensation from Rs.10,61,120/- to Rs.40,61,600/-, along with interest at the rate of 7% per annum on the enhanced compensation amount from the date of filing of the claim petition within two months.

10. We find that the order of the High Court is dated 18.09.2013 whereas the Special Leave Petition(s) were filed on 08.10.2025. There was, thus, delay of approximately 12 years, to be precise 4228 days.

11. This Court while issuing notice had put the appellant on notice that in the event he succeeded in the appeal, the period of delay would not be counted for the purpose of award of interest on the enhanced compensation.

12. In view thereof we clarify that the judgment and order of this Court dated 20.04.2026 would stand modified to the extent that the interest of 7% per annum awarded on the enhanced compensation of Rs.40,61,600/- would not be available to the appellant- claimant for the period of delay which is quantified to be 4228 days.

13. With this clarification, the Miscellaneous Application is allowed.

14. Pending application(s), if any, shall stand disposed of. …………………………………………………...J.
