1. Delay Condoned.

2. The Petitioner herein is under custody in connection with FIR No.14/2025 dated 17th January 2025, registered at Naya Shahar Police Station, Bikaner for offences alleged under Sections 406 and 120B of the Indian Penal Code, 1860.

3. The Petitioner is alleged to have cheated the accused of certain gold and silver ornaments upon the assurance of securing above-market prices with neither the ornaments nor the value of the same reimbursed.

4. The Learned Counsel for the Petitioner submits that the chargesheet with respect to the FIR has been filed warranting no further custodial interrogation and that the dispute is purely civil in nature.

5. On a prima facie consideration of the material on record, we are of the opinion that the petitioner shall be released on bail, as the offence is seen to arise from a commercial transaction and particularly, in view of prolonged pre-trial incarceration of the Petitioner of over 7 months with no witnesses being examined as of date.

6. We order that the petitioner in connection with the offence enumerated above, shall be released on bail, subject to such terms and conditions that the concerned Jurisdictional Trial Court may deem fit to impose. The petitioner shall cooperate with the trial.
