1. Leave granted.

2. Heard learned counsel for the parties.

3. This appeal arises from an order dated 27.01.2026 passed by the High Court of Punjab and Haryana at Chandigarh rejecting the regular bail prayer of the appellant in connection with FIR No. 62/2014, registered at P.S. Hodal, District Palwal (Haryana).

4. The submission of the learned counsel for the appellant is that the appellant has been implicated on the basis of confessional statement of co- accused and there is no incriminating recovery from the appellant. It is contended that the High Court has rejected the bail prayer of the appellant on the ground that he had been absconding for about nine years but the correct fact is that he was

never declared a proclaimed offender and there is no material on record to indicate that any steps taken were served on the appellant for securing his presence. Besides, the appellant has suffered pending trial incarceration of a period exceeding three and a half years. In such circumstances, it is submitted, the appellant, who has no previous criminal antecedents, may be released on bail pending trial.

5. The learned Counsel for the State-respondent has opposed the prayer for bail but could not dispute that the implication of the appellant is based on confessional statement of co-accused and he also could not point out any document or evidence to indicate that the appellant was declared a proclaimed offender.

6. In such circumstances, having regard to the fact that the appellant has suffered pending trial incarceration exceeding three and a half years, we are of the view that the appellant is entitled to be released on bail at this stage.

7. Accordingly, the appeal is allowed. The order passed by the High Court rejecting the regular bail prayer of the appellant is set aside.

8. The appellant shall be released on bail on such terms and conditions as the trial court may deem fit to impose in the facts and circumstances of the case.

9. Pending application(s), if any, shall stand disposed of.
