ORDER
The matter is listed today under the caption ‘for being mentioned’ at the instance of the learned counsel for the petitioner.
2. It is brought to my notice by the learned counsel for the petitioner that there is a typographical error occurred at paragraph No.4 of the order dated 03.09.2026 in CRP.No.4184 of 2026, that the word ‘D portion’ has been inadvertently typed as ‘B portion’. Hence, he seeks suitable correction in the said order.
3. The learned counsel for the respondents also affirms the same.
4. Considering the above, Registry is directed to carry out necessary correction, by incorporating the word ‘D portion’ instead of ‘B portion’ in the order dated 03.09.2026 and issue a fresh order copy to the parties by today. 22-09-2026 ATA

ORDER
This Civil Revision Petition has been filed to set aside the fair and Decretal Order dated 16.04.2022, passed in I.A.No.6 of 2025 in I.A.No.1 of 2019 in O.S.No.290 of 1994, by the Additional District Munsif, Namakkal.
2. The above said suit in O.S.No.290 of 1994 was filed by the deceased Ramasamy/plaintiff against the defendants 1 to 3, namely Kaliappan, Selvaraj and Nallammal, seeking partition of the suit property in four equal shares and to allot one share to him. The Trial Court decreed the said suit, by passing a preliminary decree. Thereafter, the plaintiff and the 1st defendant died and the legal heirs of the 1st defendant had filed I.A.No.1 of 2019 seeking appointment of Advocate Commissioner to divide the suit property by metes and bounds and to pass final decree.

3. Pending final proceedings, the petitioner herein filed I.A.No.6 of 2025 seeking his impleadment in the final decree proceedings stating that his vendor, namely K.Ramalingam and K.R.M.Mani had purchased the share of the 2nd defendant in the suit property, from whom, he purchased the same, by sale deed dated 17.09.1998. The said petition was dismissed by the executing court and challenging the above said order, the petitioner has come before this court.
4. The learned counsel for the petitioner, on instructions, states that a proposal has been given by the counsel for fist respondent that B portion shall be allotted to the petitioner, considering equity, though he is a subsequent purchaser ( pendentelite purchaser) and the petitioner is satisfied with the B portion being allotted to him.
5. In view of the above, this civil revision petition is disposed of, giving liberty to the parties to record the settlement in the final decree proceedings. 03-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No MST
