ORDER

This revision petition has been filed to set aside the Lok Adalat award dated 14.12.2024 in L.A.C.No.1081 of 2024 on the file of the Taluk Legal Services Committee, Mettur, in connection with O.S.No.499 of 2023 on the file of the learned Subordinate Judge, Mettur.

2. In view of the limited relief sought for in this revision petition, I am inclined to dispense with notice to the respondents.

3. Heard the learned counsel for the petitioner.

4. The petitioner challenges the Lok Adalat award dated 14.12.2024 in L.A.C.No.1081 of 2024. According to the learned counsel for the petitioner, the respondents filed a suit for partition and separate possession, besides the relief of injunction in O.S.No.499 of 2023 and behind the back of the petitioner, an award came to be passed on 14.12.2024 before the Lok Adalat, by way of settlement. The petitioner was not a party to the said partition suit and according to the petitioner, the award is a result of collusion amongst the respondents, who were plaintiffs and defendants in O.S.No.499 of 2023.

5. Admittedly, the petitioner has already filed O.S.No.564 of 2025 to declare the Lok Adalat award dated 14.12.2024 as null and void and not binding on the petitioner and for permanent injunction. The petitioner has also taken out an application in I.A.No.11 of 2026 in O.S.No.499 of 2023 for impleading himself in the said suit. Pending the suit and his impleading application, the petitioner has now come forward with the present revision petition under Article 227 of the Constitution of India, seeking the very same reliefs to declare the

Lok Adalat award as null and void and not binding upon the petitioner. Having already approached the Civil Court and the suit is pending, besides also moving the Court, which recorded the compromise by way of Lok Adalat, where he is seeking to implead himself, the petitioner cannot ride two horses and file this revision under Article 227 of the Constitution of India.

6. The grievance of the revision petitioner is that despite his application for an impleadment being filed, no order has been passed and on the contrary, the Advocate Commissioner is proceeding hastily to enable the Court to pass a final decree. In the light of the above, while dismissing the revision petition on the ground of pendency of O.S.No.464 of 2025 and I.A.No.11 of 2026 in O.S.No.499 of 2023, I direct the learned Sub Judge, Mettur to expedite hearing in I.A.Nos.10 and 11 of 2026 and dispose of the said applications, within a period of four weeks from the date of receipt of a copy of this order.

7. In fine, the Civil Revision Petition dismissed with the above direction. No costs. Connected Civil Miscellaneous Petition is closed. 22-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No ATA
