ORDER

This revision petition has been filed to set aside the docket order dated 17.07.2026 passed in EA No.2/2026 in EP No.1 of 2026 on the file of the Principal Commercial Court, Egmore, Chennai.

2. Heard the learned counsel for the parties.

3. It has been brought to my notice that pending the civil revision petition, for non compliance of the conditional order passed in E.A.No.2 of 2026, the application has been dismissed on 18.09.2026.

4. The learned counsel for the petitioner states that the petitioner is not disputing the entire suit claim. However, he is contesting only a portion of the same. The learned counsel for the petitioner would also state that he has moved the City Civil Court at Bombay to set aside the ex-parte decree passed in the commercial suit. The present revision challenges the docket order that was passed in E.A.No.2 of 2026, directing the petitioner to deposit 50% of the decreetal amount.

5. The learned counsel for the respondent states that as on date the decree amount has come close to Rs.60,00,000/- and 50% of the same would workout approximately Rs.30,00,000/-.

CRP No. 5936 of 2026

6. Considering that the revision could not be taken up, in view of the Court not sitting and that has resulted in the consequential order being passed in E.A.No.2 of 2026, I am inclined to dispose of the revision with the following directions:

(i) The petitioner shall pay Rs.5,00,000/- to the respondent-decree holder by end of 23.09.2026 and shall further deposit a sum of Rs.10,00,000/- to the credit of E.P.No.1 of 2026 within a period of six weeks from the date of receipt of a copy of this order;

(ii) Subject to the compliance of both the above conditions, the modification order in E.A.No.2 of 2026 shall stand set aside. It is made clear that in the event of default of any of these conditions, the interim protection afforded to the petitioner shall not be available and the respondent shall be at liberty to proceed to execute the decree. In the meantime, it shall be open to the petitioner approach the City Civil Court at Bombay and have the ex-parte decree set aside.

(iii) No costs. Connected Civil Miscellaneous Petition is closed. 22-09-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No ATA
