ORDER

The respondent/contemnor is present. He requests time till 31.01.2027 to vacate and hand over vacant possession citing his ill-health and the necessity for him to continue his medical shop/business to take care of his family.

2. According to the learned counsel for the respondent, he is not in any arrears of contractual rents. He also states that the respondent has paid the rent for September on 01.10.2026 at the rate of Rs.4,000/-(Rupees Four Thousand Only).

3. Learned counsel for the petitioners/landlords vehemently opposes the request for extension of time stating that the tenant himself has filed an affidavit of undertaking that he would vacate by 28.08.2026 and he has not adhered to his own undertaking and therefore, under the pretext of taking out one another

application for extension of time, the tenant cannot be granted any further indulgence.

4. Be that as it may, admittedly, the respondent/tenant is not in arrears and has paid rents upto September 2026 (Rent for September 2026 inclusive).

5. In the light of the above and also taking into account the change in the march of law and now the permissibility for Courts to impose a penalty by way of doubt rent on the tenant in the event of floating court orders, I am inclined to grant time to the respondent/tenant to vacate and hand over vacant possession by 31.01.2027 on the condition that the respondent/tenant shall pay the rent at Rs.8,000/-(Rupees Eight Thousand Only) from September 2026 onwards (inclusive of rent for the month of September 2026, in other words, for September 2026, the respondent/tenant shall pay a further sum of Rs.4,000/- (Rupees Four Thosuand Only) within a period of one week from today.

6. In respect of the rents for October, November, December, 2026 and January, 2027, the rent shall be paid in advance on or before the 10th of the same month. It is made clear that there shall be no further extension of time beyond 31.01.2027.
